End user license agreement

What you may do with the Cooked software, what you may not, and the warranty limits specific to software that drives hardware.

1. Acceptance

This agreement is entered into between PANASSE (the “Publisher”) and any person installing or using the Cooked software (the “Software”), in its free version as well as its Pro version. Installing the Software constitutes acceptance of this agreement.

This agreement exists in English and in French. In the event of any discrepancy, the French version prevails.

2. Scope of the license

The Publisher grants the user a personal, non-exclusive, non-transferable right to use the Software. The Software is licensed, not sold: the Publisher retains ownership of all intellectual property rights attached to it.

  • The free version may be used with no time limit and no account. It includes the charge limit in full and the battery status display; the other features belong to the Pro version.
  • The Pro version may be tried free of charge for 7 days, with no payment method and no account. The trial is limited to one per Mac; when it ends, the Software returns to its free version.
  • The Pro version is licensed for 1 Mac at a time. The user may release their activation from their account area and move it to another Mac when they change machine; covering two Macs at once requires two licenses.
  • Professional use by a single person is permitted. Deployment across an estate of machines belonging to an organization requires a suitable license.

3. Restrictions

The user undertakes not to:

  • resell, rent, lend, sublicense or distribute the Software or a license key;
  • circumvent, disable or tamper with the license verification mechanisms;
  • decompile, disassemble or reverse engineer the Software, beyond what the law mandatorily permits, in particular for interoperability purposes;
  • remove or alter intellectual property notices;
  • use the Software to develop a competing product by reusing its code.

4. Interaction with hardware — please read carefully

The Software changes the battery’s charging behavior by writing to the Mac’s system management controller (SMC), by means of a privileged component installed with the user’s explicit consent. This interaction is necessary for the product to work and is not a public interface documented by the hardware manufacturer.

  • The Software is designed to restore the original charging behavior as soon as it is disabled, uninstalled, or stops responding.
  • An operating system update may change or restrict access to these mechanisms and temporarily disable part of the functionality. The Software then reports what it can no longer guarantee, rather than letting you believe protection is active.
  • Active discharge spends a fraction of a charge cycle and produces heat. It is never switched on without action from the user.
  • The Software cannot repair an already degraded battery, nor restore lost capacity.

The user acknowledges using the Software in full knowledge of this interaction with the hardware. It is their responsibility to check their hardware warranty coverage with the manufacturer.

5. Warranty and exclusions

The Publisher uses reasonable means to ensure the Software works in accordance with its documentation. It does not warrant uninterrupted or error-free operation on every possible hardware and software configuration.

To the extent permitted by law, the Publisher’s liability under this agreement is limited to the amount actually paid by the user for their license.

These limitations do not apply to the mandatory statutory warranties available to consumers, nor in the event of personal injury, gross negligence or wilful misconduct. The statutory warranties are described in the terms of sale.

6. Data and absence of telemetry

The Software collects, transmits and remotely stores no usage data whatsoever. Battery measurements stay local to the machine. The Publisher makes no feature conditional on sharing data.

With the user’s agreement, the Software may check whether an update is available and validate a license key. These exchanges are limited to what is strictly necessary and never condition the operation of the charge limiter.

7. Term and termination

The license is granted for an indefinite term. It ends automatically in the event of a serious breach of the restrictions in this agreement, in particular circumvention of the license mechanism or unauthorized distribution.

The end of the Pro license does not affect the right to use the free version of the Software.

8. Third-party components

The Software may include open source components. The list of those components and the text of their respective licenses are available from within the Software. Those licenses prevail over this agreement as regards the components they cover.

9. Governing law

This agreement is governed by French law, without prejudice to the protective consumer rules applicable in the user’s country of residence. It is drawn up in French and in English; only the French version is authoritative.
